About this website

The Foundation for Credit Counselling (FCC), trading as StepChange Debt Charity in the United Kingdom, is a registered charity and a not-for-profit organisation providing money management advice, confidential budgeting, debt advice and debt management plans for both individuals and families.

This website aims to provide the Creditors of Clients on Debt Management Plans (DMPs) or Token Payment Plans (TPPs) with a quick and easy facility to enquire about the status of the plan with StepChange Debt Charity and to exchange information with them.

Data Protection

The service provided by StepChange Debt Charity is completely free to their Clients. StepChange Debt Charity is completely committed to respecting and protecting the privacy of their Clients. The information contained within this site is processed in accordance the StepChange Debt Charity Privacy Notice, of which each of their Clients has been informed. A copy of the StepChange Debt Charity Privacy Notice can be found here and complies with General Data Protection.

By using this site, you are agreeing to be bound by these terms to ensure compliance with the StepChange Debt Charity Privacy Notice, the General Data Protection Regulations and all UK law including any contractual clauses in place between you and StepChange Debt Charity.

Terms

By using this site, you (and your organisation) agree to:

  1. Place appropriate security measures to prevent the client personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed
  2. Limit access to the personal information to those employees within your business, who have a legitimate need to know;
  3. Only process the personal information on instructions from StepChange Debt Charity owing a duty of confidentiality;
  4. make certain Client Personal information controlled by your business available to StepChange from time to time as permitted by the General Data Protection Regulations, or in line with contracts between your business and StepChange Debt Charity;
  5. having regard to the state of technological development, take all appropriate technical, security, and organisational measures necessary or desirable in relation to the processing of Personal Information contained within Creditor Web;
  6. ensure a level of security appropriate to the harm that might result from such unauthorised or unlawful Processing or accidental loss, destruction or damage and the nature of the Personal Information to be protected;
  7. at the request of StepChange Debt Charity, promptly provide a written description of the technical and organisational methods employed by your business or any party where you have shared the client personal information for Processing Personal Information by yourself or on behalf your business and any other information necessary to demonstrate compliance with that party's obligations under any agreement;
  8. make all reasonable endeavours to ensure that in the course of sharing data and information so it does not introduce any computer viruses, worms, software bombs or similar items into software programmes, items of hardware, databases or other systems;
  9. use all reasonable endeavours to assist the StepChange Debt Charity to comply with any obligations imposed on it by the Data Protection Legislation and the Data Privacy Laws (in so far as they relate to creditor Web) including, but not limited to, complying with any subject access request or other request relating to the Processing of Personal Information from a Client under the Data Protection Legislation and the Data Privacy Laws ("Data Request") or communicating with the ICO in relation to the Processing of Personal Data ("ICO Correspondence");
  10. retain and process all Client Personal information within the European Economic Area or only disclose the information contained therein to any third party Data Processor, or any member of its Group, in each case outside of this area where permitted under the Data Protection Legislation;
  11. promptly (and in any event within any necessary timeframes prescribed by law) notify StepChange Debt Charity of any unauthorised or unlawful Processing, disclosure, loss of, damage to, corruption of or destruction of any Personal Information made available and/or received from StepChange Debt Charity;
  12. subject to any applicable statutory or professional retention periods, not retain or Process any Personal Information made available and/or received from the other party for longer than is necessary to carry out the purpose(s) for which it has been made available and/or provided and shall securely destroy any such Personal Data once the Processing of it is no longer necessary for such purpose(s); and
  13. promptly notify StepChange about:
    1. the receipt of any Data Request or ICO Correspondence of relevance and use all reasonable endeavours not to disclose any Personal Data in response to any Data Request or ICO Correspondence of relevance, or to respond to such a request, without first consulting with StepChange;
    2. a complaint relating to StepChange Debt Charity’s obligations under the Data Protection Legislation and the Data Privacy Laws; or
    3. the receipt of a request from a Client to cease or not begin Processing their Personal Data, to rectify, correct, amend, block, withdraw, erase, delete or destroy their Personal Data or to withdraw or amend their Creditor Consent, Charity Consent, Charity Authority and/or Joint Consent and Authority (as the case may be).

The content of this website may be changed or access to it may be withdrawn at any time.

Governing Law and Jurisdiction

These terms of use shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.
